Nigerian Bar Association Condemns Alleged Courtroom Order For Lawyer to Kneel, Insists on Rule of Law

The Nigerian Bar Association (NBA) has raised concerns over reports of an incident involving a judge of the Federal High Court in Abuja and a defence lawyer, stressing that no Nigerian law permits a judge to compel a lawyer to kneel in court.

 

In a statement issued on Tuesday, NBA President Afam Osigwe expressed unease over allegations that Mohammed Umar, a judge of the Federal High Court, instructed a lawyer, Marshall Abubakar, to kneel during proceedings.

 

The reported incident occurred on Monday when Abubakar appeared as lead counsel for Omoyele Sowore. It was alleged that the judge reacted after the lawyer raised his voice while addressing the court over the appropriateness of a scheduled hearing date, and also threatened contempt proceedings.

 

The NBA described the situation as deeply troubling, noting that it touches on both the dignity of the legal profession and the integrity of courtroom proceedings. The association emphasised that while judges have the authority to maintain order, such powers must be exercised strictly within the limits of the law and established judicial standards.

 

The body acknowledged that courts are empowered to punish contempt but pointed out that such actions must follow clearly defined legal procedures that ensure fairness and respect for individuals’ rights and dignity.

 

According to the NBA, instructing anyone, including a lawyer, to kneel is not a recognised form of judicial sanction under Nigerian law and falls short of expected standards of judicial conduct.

 

The association stressed that maintaining the dignity of the court goes beyond rulings and extends to how judicial authority is exercised. It advised that where a judge believes someone has acted contemptuously, proper legal procedures must be followed in addressing the issue.

 

At the same time, the NBA reminded lawyers of their responsibility to act professionally, respectfully, and with restraint in court, even while advocating strongly for their clients.

 

Highlighting the importance of mutual respect between the Bar and the Bench, the association described their relationship as essential to the proper administration of justice.

 

The NBA concluded by urging calm and encouraging that any disputes arising from courtroom conduct be handled through appropriate institutional and disciplinary channels. It also noted its readiness to engage relevant authorities where necessary to uphold the rule of law, professional ethics, and judicial standards.
